TERMS AND CONDITIONS OF USE

By using this website and by making appointments for services of To Be Revealed Spiritual Health, LLC (hereinafter, “TBR), you are agreeing to be bound by the following terms and conditions of use (“Terms and Conditions” or “Agreement”).

 TBR reserves the right to update and change the Terms and Conditions from time to time without notice. Continued use of the website after any such changes shall constitute your consent to such changes. 1.             Appointment Scheduling. You represent and warrant that you are at least eighteen (18) years of age if you are scheduling an appointment with us for yourself or your minor; (ii) you must provide a valid and authorized payment information and agree that TBR may charge the selected method of payment 24 hours prior to your appointment or at the time of your appointment; (iii) you will pay all charges incurred in connection with your appointment; (iv) you will pay all applicable taxes; and (v) if TBR does not receive payment from your payment card issuer, you will pay all amounts due upon demand.

 2.             Appointment Cancellation. You may cancel your appointment at any time by providing at least 24 hours prior notice. Cancellations may be submitted through our website www.TBRSpiritualHealth.com, by contacting us by email at [email protected] or by phone at 720-782-6090. If you miss your appointment and fail to cancel with 24 hours prior notice or reschedule as provided below, you agree that TBR will charge your credit card for the missed appointment.

3.             Appointment Rescheduling. You may reschedule a previously-booked appointment. Rescheduling requests may be submitted through our website www.TBRSpiritualHealth.com, by contacting us by email at [email protected] or by phone at 720-782-6090. We may reschedule a previously-booked appointment in the event we cannot perform our services for you at the time of your scheduled appointment.

4.             Memberships. We offer a variety of membership packages whereby our services are provided at a reduced rate. You may purchase a membership through our website www.TBRSpiritualHealth.com , by contacting us by email at [email protected] or by phone at 720-782-6090. Our membership billing packages are designed to be ongoing on a monthly basis for one, two, or three sessions based on the selection you chose. (For example, if you purchase membership package for one session, you will be billed monthly for 1 session until canceled; if you purchase a membership package for two sessions, you will be billed monthly for two sessions a month until canceled). You authorize TBR to charge your credit card per each applicable billing cycle. A session cannot be applied to your account prior to the payment being processed. You understand that if you book an additional service prior to the payment processing you agree to pay for the service separate from your membership, however a discounted member price will be offered to you. You may cancel your membership at any time with at least 30 days prior written notice; however, if you used a session prior to the applicable billing cycle date you agree that your card will be charged for that session at the time of cancellation. A membership is not transferable.

5.             Expiration of Unused Sessions on Membership Plan. Each session purchased through a membership plan expires six months from the date of the billing cycle.

6.             Services Pricing. Pricing for our services may change from time to time. If you have booked an appointment, we will honor the price quoted at the time of booking. If you purchased a membership and the pricing has changed during a billing cycle, you will be notified as to when the pricing change will go into effect.

7.             Gift Cards. We sell gift cards using denominational values. Gift card values expire six months from the date of purchase and can be used toward the purchase of any of our services. Gift cards are not redeemable for cash. If you purchase a gift card to be delivered by electronic mail you represent and warrant that the recipient’s email address is correct. You acknowledge that our gift card to your recipient may be filtered through their email provider’s spam filter and may not be received by your recipient in their primary inbox. Gift card sales are final and nonrefundable.

8.             Forms. Prior to your first appointment you agree to complete any and all health, medical, consent forms requested by TBR. All forms are submitted online. We may require additional consent forms. We will advise you of the forms that are necessary prior to your first appointment. Forms submitted online are processed through our third-party practice management software.

9.             Minors. No children under the age of 18 will be able to receive any service without the express written consent of their parent or guardian. A parent or guardian must remain on premises during services.

 10.          As-Is; Disclaimer of Warranties. The TBR Website and related communications are provided “as is” without any representations or warranties, express or implied, of any kind. TBR specifically disclaims any warranties of merchantability, fitness for a particular purpose and/or non-infringement.

11.          Limitation of Liability. TBR IS NOT LIABLE FOR ANY LOSS OF USE, LOSS OF DATA, INTERRUPTION OF BUSINESS, DOWNTIME, LOST PROFITS, OR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND REGARDLESS OF THE FORM OF ACTION WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT PRODUCT LIABILITY, OR OTHERWISE, EVEN IF IT HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. IN NO EVENT SHALL TBR LIABILITY EXCEED REIMBURSEMENT OF ANY MONIES PAID BY YOU UNDER THIS AGREEMENT AND THIS SHALL BE YOUR EXCLUSIVE AND SOLE REMEDY FOR ANY CLAIM HEREUNDER. THIS SECTION SHALL SURVIVE THE TERMINATION OR EXPIRATION OF THIS AGREEMENT.

12.          Indemnification. You agree to defend, indemnify and hold harmless TBR and its affiliates, members, managers, employees and agents, and waive and release all such parties from all claims, causes of action, suits, allegations, liabilities, expenses, injuries, losses and damages incurred or suffered by TBR arising out of or based on any claim or threatened claim based on your use of or access to the website, your violation or breach of any of these Terms and Conditions, or any violation of any intellectual property rights of any third party.

13.          Miscellaneous Terms.

a.             Force Majeure. TBR is not liable for any delay in providing any products or materials hereunder, including but not limited to those arising out of fire, flood, explosion, war, strike, power blackout, nature, general supply chain issues, shipping delays, civil or military authority, pandemic, epidemic, inability to obtain labor or materials or reasonable substitutes therefore, terrorist threats or activities or any other cause beyond TBR’s reasonable control or acts of God.

b.             Governing Law and Venue. These Terms and Conditions will be governed by and construed in accordance with the laws of the State of Colorado, without regard to the principles of conflicts of law, except to the extent those laws are preempted by federal law. The proper venue for any proceeding at law or in equity will be Denver County, Colorado, and the parties waive any right to object to the venue.

c.             Attorneys’ Fees. The prevailing party in any dispute regarding this Agreement shall be entitled to receive, in addition to any other remedy or award, reasonable attorneys’ fees and costs incurred in the enforcement of its rights under this Agreement.

d.             Severability. The provisions of this Agreement are independent of and separable from each other, and no provision shall be affected or rendered invalid or unenforceable for any reason any other or others of them may be invalid or unenforceable in whole or in part.
